ARCpoint of Las Vegas Frequently Asked Questions

Drug Testing

Urine Tests
Can you come to my business site to collect urine specimens?
A. We do service on site collections within the Las Vegas Nevada area, though appointments are needed.
How secure are your collections of urine specimens?
A. Urine is collected in a very secure specially designed cup and then sealed with tamper resistant tape. Please call our Las Vegas office at (702) 505-9883 for more on our secure urine collection methods
Can you detect adulterants through urine tests?
A. There are 2 different kinds of adulterants commonly used to manipulate results: household chemicals such as bleach or drain cleaner and commercial products purchased via the web. In both cases adulterant tests can be used to detect these kinds of attempts.
What happens if an employee drinks too much water to dilute a urine specimen?
A. If a person is trying to hide a drug in their system they may try to dilute their specimen by drinking too much water. In this case the results would return as an automatic fail and classified as a false positive. The specimen would then be sent to the lab for further adulteration inspection.
What drugs show in a urine test?
A. A typical urine specimen check includes: Amphetamines, Cannabinoids, Cocaine, Opiates, and Phencyclidine. An extended test can be ordered that will identify alcohol, barbiturates, benzodiazepines, hydrocodone, MDMA, methadone, methaqualone, and/or propoxyphene.
How long are drugs detectable in a urine specimen?
A. Detection times vary depending on the type of drug used and the frequency of use. Frequent drug users will experience much longer detection times than those listed in the chart below. Common drug detection times are:
  • Amphetamines,1-2 days
  • Cocaine,1-4 days
  • LSD,8 hours
  • Marijuana,1-14 days
  • Heroin,1-2 days
  • Methadone,1-7 days
  • Barbiturates,2-10 days
I have friends that smoke marijuana. Will I test positive for marijuana because I may have inhaled it secondhand?
A. This is unlikely. A positive result indicates that an individual has passed the 50 ng/ml cutoff level, which is almost impossible to do by passive inhalation alone.
Is it true that there are prescription medications that will cause a positive drug test?
A. Yes, there are more than 100 prescription medications that will create a positive result. That is why all drug screening programs include a qualified Medical Review Officer who reviews all positive test results. It is the MRO's job to review the test and confirm any legitimate use of medications or other factors that may cause a positive result.
Is it possible for someone to pass a drug test by bringing in someone else's 'clean' urine?
A.  Many people have tried this in the past. That is why all specimens are tested for temperature. Freshly discharged human urine falls within a specific temperature range that substituted specimens cannot match.
Hair Follicle Tests
How many days does a hair follicle test cover?
A. If drugs have been ingested into a person’s system, a strand of hair can provide information on the type of drug use within the past 90 days.
Does your drug testing program include hair follicle testing?
A. There are many different drug testing programs. Hair follicle can be included in your program for random as well as mandated testing.
Does the person being tested need to be present for a hair follicle test?
A. It is better to have the person present. We cut a strand of hair as close to the scalp as possible, for the most accurate results.
What drugs show in a hair test?
A. Hair testing can detect all major drugs, including nicotine, methadone, benzodiazepines, antidepressants and mescaline. A standard test evaluates the five drug classes mandated by the federal government: Cocaine, Marijuana, Opiates, Methamphetamine, Phencyclidine
How long are drugs detectable in a hair specimen?
A. Hair grows at a rate of approximately 1/2 inch per month. Therefore, each 1/2 inch of hair can show all the drugs used in a given month. A typical hair specimen consists of the 1.5 inches of hair closest to the scalp and shows the last 90 days of use.
How long after consumption does it take for evidence of drug use to show on a hair specimen?
A. It takes approximately one week after consumption for drug use to show on a hair sample. That is because the hair must grow above the scalp before it can be tested.
How does hair testing work?
A. When drugs are consumed, they are metabolized by the body. As drug molecules and their metabolites find their way into the bloodstream, they become embedded inside the hair shaft. As the hair grows, the molecules are trapped inside the hair strand.
Is it true that certain shampoo can erase evidences of drug use and result in a clean test?
A. No shampoo or external chemical can alter the molecular composition of the hair shaft. Since the drug molecules are inside the strand of hair, they cannot be 'washed' off.
What if somebody shaves their head to avoid testing?
A. While head hair is preferred, body hair can be substituted in a hair drug test. Because it grows much slower than head hair, the specimen does not need to be a certain length. However, body hair cannot be analyzed to show month-by-month use as head hair can.
Is it true that redheads are more likely to test positive for drugs?
A.  Hair color has no bearing on test results. Hair color is determined by the amount of melanin in the hair. Melanin and drug molecules are completely independent and unaffected by each other. Controlled lab experiments have proven that hair color has no impact on the test result.
How does a hair test compare to a urinalysis?
A. Hair testing offers a wider window of detection and there are no effective ways to tamper with the specimen. Collection methods are completely non-intrusive.
How much hair is required for a test?
A. A quality specimen should be between 50 to 150 strands, depending on the thickness and coarseness of hair.
Will I test positive for drug use if I have been exposed to marijuana smoke?
A. No. The drugs and their metabolites are found inside the hair follicle, and external exposure cannot affect that. Metabolites are produced inside the body and cannot be considered an external contaminant.
Can a hair test determine the difference between Ritalin (or other medications) and methamphetamine use?
A. Yes. Because hair samples evaluate the drug molecules and metabolites in the hair, it is possible for a hair test to identify the difference between prescriptions such as Ritalin and other stimulants, such as methamphetamines.
Steroid Tests
What is the average age of a steroid user?
A. 15 years old.
What are long term side effects of steroid use?
A. Long term side effects of steroid use include; high blood pressure, liver tumors, liquid retention, jaundice, irritability, delusions, and jealousy.
Do you need a prescription for steroids?
A. Legally you do need a prescription but obtaining steroids is easily done without a prescription, more than 1,000,000 Americans have used steroids without a prescription
Why are steroids dangerous?
A. Steroids contain high amounts of testosterone (the male sex hormone) which causes many serious side effects.
Is it true that steroids are just a problem with males?
A. No. Traditionally, steroids are viewed as something that only male athletes use. However, there is an increasing trend in female steroid use, especially among teenagers. More than 2.8% of female middle school students have used steroids, primarily as a means to 'trim down' and 'sculpt' their bodies.
What is the big deal about steroid use, anyway?
A. Steroids are made of cholesterol, sex hormones, and high concentrations of naturally occurring corticosteroids. Because most steroids contain large amounts of testosterone, they can be very dangerous-especially to teenagers whose bodies are still developing. They can stunt growth, result in infertility, and halt female sexual development.
What are the symptoms of steroid abuse in males?
A. In males, symptoms include:
  • Shrinking of testicles
  • Reduced sperm count
  • Development of breasts
  • Baldness
  • Infertility
What are the symptoms of steroid abuse in females?
A. In females, symptoms include:
  • Growth of facial hair
  • Enlargement of the clitoris
  • Deepening of voice
  • Changes in menstrual cycle
  • Cessation of menstrual cycle
What are the most commonly abused steroids?
A. Anabolic steroids are the most commonly abused steroids today. They were originally developed in the late 1930s to treat a condition called 'hypogonadism,' where the testes do not produce adequate testosterone for males to grow and develop normally. They are illegal without a prescription, but are commonly used by female teenagers to slim their bodies, and by males to improve sports performance.
Are steroids produced naturally in the body?
A. The adrenal cortex of the brain produces corticosteroids, which help balance glucose and electrolytes in the body. In a healthy individual, the body produces exactly the right amount of corticosteroids. Taking un-prescribed steroids can alter these internal balances.
How does ARCpoint prevent 'cheating' on steroid tests?
A. Steroid abusers generally default to one of the following tactics to 'cheat' a steroid test:
  • Using a blocking agent, such as Probenecid, theoretically reduces the excretion of steroid metabolites. These agents are not effective and are also on a list of banned substances for athletes. They can be easily detected in a drug test.
  • Diuretics dilute the urine by increasing the water content of urine. This has been combated by establishing a specific gravity test. This test establishes the gravity of a substance compared to the gravity of water. Diluted urine has a much lower specific gravity than normal urine.
  • Abusers often 'substitute' a non-drug user's urine for their own. Female abusers generally do this by hiding a condom filled with 'clean' urine in the vagina. This method has led to supervised sample collection.
  • Extreme abusers may implement catheterization as a method to beat a test. This is accomplished by inserting a long, thin rubber tube through the urethra and into the bladder. The bladder is then emptied and refilled with 'clean' urine. This procedure is very painful and often results in serious infection, hemorrhaging, and bladder rupture. It is also ineffective, because there is usually enough fluid on the walls of the bladder to contaminate the substituted urine.
What methods can be used to test for steroids?
A. Typically, urine and hair samples are tested for steroids.
What types of steroids are there?
A. Androgenic steroids result in rapid increased muscle mass. Corticosteroids regulate inflammation in the body and help with injury. They are commonly used to treat asthma, arthritis, and kidney disease. Anabolic steroids cause growth and thickening in the body's tissues, including the muscles, bones, and vocal cords. They also reduce body fat. Because of this, they are the most commonly abused form of steroids.
I think my nephew is abusing steroids. Do I need to know which type before I can have him tested?
A. It definitely helps to know what kind of steroids you are testing for. Because the test varies slightly depending on the variety, multiple tests may be required to eliminate all types. However, anabolic steroids are the most commonly abused, followed by androgenic. Researching the effects of these steroids can help you make an educated decision, based on what you have observed.
Can ARCpoint help me implement a drug and steroid testing program in my athletics organization?
A. Yes. ARCpoint can manage your entire drug, alcohol, and/or steroid testing program. We will maintain all of the documentation for auditing purposes, leaving you to focus on your sport and team.
What if I want a participant to take a test outside of normal business hours?
A. ARCpoint works with a network of other collections sites to meet all of your needs. After-hours collections can take place at a number of other facilities. Please contact our office for alternative locations in your area.
What are anabolic steroids?
A. Anabolic steroids are man-made substances that are closely related to testosterone, the male sex hormone. They are typically abused by athletes in order to promote and speed up muscle development. These steroids work by binding to receptor sites and stimulating protein synthesis. It often results in muscle strength and endurance far beyond the normal range that can be accomplished merely by normal training. They are, however, very dangerous-especially to young athletes and females. They are also banned by most athletic organizations.
How are anabolic steroids detected?
A. The most common steroid testing method is a urine test panel. Our panel reflects the requirements held by the NCAA and the American Olympic Committee.
Fingernail Tests
What period of time does a fingernail test cover
A. A relatively small fingernail sample can show up to 6 months of drug use history.
Is fingernail drug testing technology new?
A. Drugs have been detected in nails since 1984, but other methods of testing were cheaper or more convenient. Now, the need to test for a longer duration of drug use has made fingernail testing more common.
How much fingernail is required for a test?
A. Fingernails can be clipped, with each 3-5 mm representing one month of use. If length does not allow, the nail can be shaved through a safe and pain-free process that provides the same, reliable results as a clipping.
What drugs show in a fingernail test?
A. Fingernail testing can identify all major drug types, including the five designated by federal mandate: Amphetamines, Cannabinoids, Cocaine, Opiates, Phencyclidine
How does fingernail testing work?
A. Fingernails and toenails are made of keratin, a hard protein. Similar to hair, drugs are incorporated into the protein from the blood stream. As the nail grows, evidence of the drug use is trapped in the keratin. After the sample is taken, it is cleaned in a chemical solution to destroy all external contaminants. Then it is liquefied and testing through a 5 or 10 panel screening.
Can toenails be tested?
A. Yes. Toenails grow much slower than fingernails, at a rate of 1 mm per month instead of 3-5 mm per month. Toenails can be tested through the same process, and can show a 12 month history of drug use, depending on length of the sample.
Can fingernail polish alter fingernail test results?
A. After the specimen is taken, it is soaked in a chemical solution. This removes the surface of any external contaminants, including fingernail polish.
Can a fingernail test be adulterated?
A. No. Because the drug residue is in the keratin, which prevents outside additives such as hand washes, polishes, soaks, and other chemical adulterants from affecting the test result. The nail sample is cleaned thoroughly with a chemical solution in the lab, which further removes the effect of these items.
Saliva Tests
How are saliva tests most commonly used?
A. Because of the short detection duration, saliva tests are most commonly used for post-accident drug use verification.
How common are saliva drug tests?
A. 30% of American employers use saliva drug tests as a means to verify drug use in post-accident and employment situations.
Can certain types of mouthwash alter results?
A. No. The swab is placed for two minutes and absorbs fresh saliva, which contains metabolites and drug molecules.
What drugs show in a saliva test?
A. Saliva testing can identify all major drug types, including the five designated by federal mandate: Amphetamines, Cannabinoids, Cocaine, Opiates, Phencyclidine
How long are drugs detectable in a saliva specimen?
A. The duration of detection depends on the drug used and the frequency of use. Marijuana is detectable for 24 hours with moderate use, while barbiturates are detectable up to 4 weeks after the event.
How does saliva testing work?
A. Using a swab that resembles a small toothbrush with a pad instead of bristles, a sample is collected from between the lower cheek and gum. The pad is placed in this location for approximately 2 minutes before being transferred to a collection vial.
Can a saliva specimen be adulterated?
A. No. Because there is nothing intimate or personal about the collection procedure, it is overseen by professionals. This leaves no opportunity for alteration.
How reliable are saliva drug tests?
A. The University of Utah in Salt Lake City concludes that saliva is a reliable medium for drug detection. The Center for Human Toxicology states that drug use and concentrations can be determined by analyzing saliva.
How much saliva is required for a test?
A. When the swab collector is saturated, enough saliva has been gathered.
Are there any special preparations necessary for a saliva test?
A. Eating is not recommended immediately prior to a saliva test. However, while this will complicate the test, it will not make the test impossible nor will it alter the test results.
Skin Patch Tests
How long is the sweat patch worn?
A. Each patch is worn for 7 to 14 days.
What prevents the individual wearing a sweat patch from transferring it to a 'clean' individual?
A. The sweat patch is equipped with a unique sticky surface that prevents transferring. The patch will only adhere once. Once it is removed, it will not stick to another surface.
Is it likely that I will have an allergic reaction to the patch?
A. Many individuals who have used the skin patch have reported mild irritation around the patch site. After removal, it is common to have small bumps or rashes for a few days.
What drugs show in a sweat patch test?
A. Sweat patch testing can identify only the five drug categories designated by federal mandate: Amphetamines, Cannabinoids, Cocaine, Opiates, Phencyclidine
How does a sweat patch drug test work?
A. The individual wears a sweat patch that resembles a giant band-aid. It is applied to the shoulder where it gathers sweat over the 7-14 day period it is worn. Then, the collected sweat is screened for drug evidence.
How long has sweat patch drug testing been used?
A. Probation departments have used this technology since 1992. It is popular with probation and parole officers, social service workers, and parents trying to prove drug abstinence to Child Protective Services.
Are the results of a sweat patch test court admissible?
A. Each court makes its own decision about whether sweat patches can be admitted as evidence. In most cases, courts have admitted sweat patch evidence and used it as the key deciding factor in probation and custody cases.
How common are sweat patch tests?
A. There are 300,000 sweat patch tests conducted every year.
Instant Tests
How does saliva testing work?
A. Using a swab that resembles a small toothbrush with a pad instead of bristles, a sample is collected from between the lower cheek and gum. The pad is placed in this location for approximately 2 minutes before being transferred to a collection vial.
Is it possible to pass a test with a urine substitute?
A. A Specimen Validity Test (SVT) tests for the protein creatinine, a protein is always present in human urine. If there is no creatinine present, the specimen is not human urine. Also, the test checks for Specific Gravity and pH. Together, these three tests provide measured results that can effectively evaluate if the specimen is human urine.
I eat a poppy seed muffin or bagel every morning for breakfast. Is it true that this could make me test positive for opiates?
A. Yes. Poppy seeds can cause a positive result for opiates for up to 48 hours after consumption. In fact, prison inmates and those on parole are prohibited from consuming poppy seeds. Many paroled individuals have been returned to prison because they violated the 'no poppy seed' rule and failed a urine test.
Environmental Testing
What drugs does a DrugWipe detect?
A. A standard DrugWipe test detects the five categories of drug mandated by the federal government. The test will register positive if either the actual drug or drug metabolites are detected.
  • Amphetamines
  • Cannabinoids
  • Cocaine
  • Opiates
  • Phencyclidine
However, DrugWipes are available in various formats, including a single test and dual test kit.
How accurate is a DrugWipe at detecting drug residue on surfaces?
A. DrugWipes have been proven 100% accurate for surface testing in tests conducted in 1996 by the Office of National Drug Control Policy.
Can the DrugWipe test more than just surfaces?
A. Yes, but the reliability is slightly decreased. The DrugWipe can test sweat or saliva with an accuracy of 94-97%, as determined by the Office of National Drug Control Policy in 1996.
If I use the 5-panel, how will I know what drugs the DrugWipe detected?
A. The 5-panel DrugWipe test is divided into 5 sections. Each section contains antibodies that fit components of different drugs. If the particular drug is detected, a color change will occur in that section of the test.
Who uses DrugWipe tests?
A. DrugWipe tests are very popular with law enforcement agencies, schools, workplaces, and government. In many foreign countries (including Germany, Australia, and Switzerland), they are used by law enforcement as a method for roadside screening of drivers under the influence of drugs.
How long does it take to get results with a DrugWipe test?
A. The colored reaction to the drug generally occurs in 1 to 5 minutes.
Can a DrugWipe test be used more than once?
A. No. DrugWipes are a one-time, disposable test strip.
How big is the DrugWipe test strip?
A. It's about the size of a pen, comparable to an at-home pregnancy test stick.
How does drug residue get onto a surface?
A. Aside from the obvious answers of trafficking and drug use, drug users typically leave a trail of residue on the surfaces that they touch. This occurs through actual residue on the fingers as well as through drug compounds excreted in sweat.
Alcohol Etg Ets Tests
What are the methods for alcohol testing?
A. Alcohol testing can be done with through a breath test, a urine test, or a hair test.
I am a casual drinker that only consumes alcohol on weekends. Will I lose my job over a positive alcohol test?
A. Most alcohol testing devices have cutoff levels that prevent responsible drinkers from being tested positive for binge or heavy drinking. The tests that do not have these cutoffs are generally used to prove alcohol abstinence and are not likely to be used by an employer.
Can a DOT-regulated commercial motor vehicle driver use a prescription and still perform safety-sensitive duties?
A. Yes, under certain circumstances and as long as the prescription in question is not methadone. Regulations state that, 'A person is physically qualified to drive a CMV if that person does not use a controlled substance.' A driver may use such a substance or drug, if the substance or drug is prescribed by a licensed medical practitioner who is familiar with the driver's medical history and assigned duties; and has advised the driver that the prescribed substance or drug will not adversely affect the driver's ability to safely operate a CMV. This exception does not apply to methadone.
Is alcohol urine testing a good method for testing alcohol use?
A. Urine testing for EtG and EtS metabolites is a very accurate way to determine all recent alcohol use. It is highly sensitive and can detect a single drink for 24 hours after it was consumed.
How long is alcohol detectable using a urine test?
A. A single drink can be detected for approximately 24 hours. Binge drinking or heavy consumption can register on a test for as long as 80 days after ingestion.
How does urine testing for EtG and EtS metabolites work?
A. A urine sample is procured and tested for metabolites. EtG and EtS are produced by the body after it metabolizes alcohol. Even after the alcohol itself is eliminated from the body, these metabolites linger.
Alcohol Breath Tests
How long do results for a breathalyzer test take?
A. Results are immediate.
How does a breath test work?
A. Breath alcohol is measured by having the participant breathe into a device. When a sufficient amount of air has been expelled into the device, it measures the alcohol content in the breath. Breath alcohol content is directly correlated to blood alcohol content.
How long is alcohol detectable using a breathalyzer
A. Depending on the individual, the length of time alcohol is detectable will vary. However, it is typically a matter of hours.
Does ARCpoint of Las Vegas use official breathalyzers?
A. These units are approved by the NHTSA and are used for DOT certified tests. These tests can be done at our facility or on-site.
Alcohol Etg Hair Tests
How does alcohol hair testing work?
A. A sample of hair is cut and analyzed for alcohol markers. The body produces EtG and EtS when alcohol is present in the bloodstream, and these markers are absorbed into the hair structure.
How long can alcohol be detected in a hair sample?
A. Alcohol markers are detectable up to 60 days in a hair sample.
What are common uses for alcohol hair testing?
A. This test is sensitive and can show an extended history. It is often used in parent custody cases, identifying an alcohol abuser in an employment screening, and proves long-term abstinence or eligibility for a liver transplant.
Is hair testing for EtG and EtS metabolites an accurate method of detecting alcohol?
A. Hair testing for EtG and EtS metabolites is a very accurate way to determine all recent alcohol use. It is highly sensitive and can detect alcohol consumption even months after the event.
Alcohol Passive Tests
Does a PAS test work if an accident victim is unconscious
A. Yes, and because the test does not require consent it is possible to test someone without their knowledge.
Can a PAS devise detect an open container in a vehicle?
A. The PAS devise is very sensitive to the presents of alcohol, it can detect an open container in a vehicle as well as well as alcohol on the breath of your passengers.
Random Drug Alcohol Testing
What if my organization is accused of discrimination in its testing policies?
A. ARCpoint uses fully randomized software to randomly generate names for testing. If the organization is accused of discrimination while using ARCpoint to provide random name generation, they cannot be held liable because the organization has outsourced its name generation to our facility. Furthermore, the testing is entirely random, so this event is very unlikely.
What random name generation services does ARCpoint offer?
A. ARCpoint offers fully random name generation services and can even manage your drug testing program.
Why should my organization use random name generation?
A. Random name generation is an important facet of a successful random drug testing policy. Without random name generation, employers and other organizational leaders may be accused of testing based on suspicion. Without random name generation, a company or organization could easily be held liable for discrimination in their testing policies.
Mobile On Site Testing
Can you provide mobile, on site testing for Non-DOT regulation clients?
A. ARCpoint of the Las Vegas Valley area can provide mobile testing and collection services to both DOT and Non-DOT regulated businesses.
If ARCpoint performs testing at my place of employment are the results still under DOT regulations?
A. Yes, all testing preformed by ARCpoint of the Las Vegas Valley area are preformed under D.O.T. standards.

Federal Dot Testing

24 Hr Post Accident Testing
Do you offer D.O.T. testing for accidents after hours?
A. Yes. ARCpoint works hard to provide all D.O.T. required services. Call us at (702) 505-9883 for more information.
Is your onsite - mobile testing a certified breath test?
A. Yes
Audit Preparation
How does a company benefit from participating in an ARCpoint DOT mock audit?
A. Companies use our DOT Mock Audit services to evaluate how prepared they are for a real Department of Transportation audit. By knowing they have the required documentation and processes, they do not need to fear the DOT's auditing department.
What does a mock audit evaluate?
A. ARCpoint' mock audits include evaluations of driver logs, manuals, maintenance, safety, and other key concerns that would be evaluated by the real Department of Transportation in the event of a real DOT audit.
Will ARCpoint help my company correct errors and other non-compliance with DOT protocol as discovered in a mock audit?
A. Yes. ARCpoint provides consulting in all aspects of DOT protocol, including the evaluation and correction of processes such as driver logs, manuals, maintenance, and safety.
Employee Supervisor Training
Why should the company's supervisors be trained as a part of a Drug-Free Workplace program?
A. Supervisor's observations are often more accurate than a drug test. As they monitor employee performance and behaviors, trained supervisors can often identify a drug or alcohol abusers and recommend those employees to a take a drug test based on suspicion.
Does ARCpoint provide alcohol detection training in accordance with D.O.T. policy?
A. ARCpoint offers testing and training in accordance to 49 CFR Part 40, as required by the Department of Transportation (DOT). To become qualified students must:
  • The student must be trained on the rules/regulations of Federal Alcohol Testing through a 6 1/2 hour classroom lecture
  • The student must demonstrate proficiency in administering an alcohol test using the EBT instrument.
  • The student must perform a minimum of 7 mock tests on a live subject using the instrument.
What should a supervisor do if he or she suspects that an employee is abusing drugs and alcohol?
A. The US Department of Labor recommends that supervisors suspicious of abuse should escort the employee to a private area to ask about the employee's behavior. If possible, the supervisor should call in another supervisor or manager who can serve as a witness to the conversation. Then, the supervisor should inform the employee of his or her concerns and allow the employee to give an explanation. Based on the outcome, the supervisor should notify senior management, who may or may not decide to place the employee on suspension pending a formal investigation. If a suspension is mandated, management should arrange for the employee to be escorted home-after all, if the employee is not in satisfactory shape to work, he or she is in no shape to drive themselves anywhere.
Policy Creation
What features should a proper Drug Testing policy contain?
A. A proper Drug Testing policy should contain the following:
  • The policy should contain a detailed description of what is prohibited. Can drugs be consumed at work? Alcohol? Should employees report to work when under the influence? Address all these things.
  • The policy should be tailored to your work environment and the work performed.
  • The policy should provide for a variety of testing contingencies, including random, post accident, and pre-employment.
  • Employees should sign acknowledgements that they have received and read the policy and that they consent to testing.
Company policies also need to conform to any applicable government regulations, such as those set forth by the Department of Transportation.
Why should my company have a drug testing policy?
A. Establishing a drug testing policy helps reinforce your company as a drug-free workplace, and educates employees on what is prohibited and the consequences of breaking those prohibitions.
Random Name Generation
What if my organization is accused of discrimination in its testing policies?
A. ARCpoint uses fully randomized software to randomly generate names for testing. If the organization is accused of discrimination while using ARCpoint to provide random name generation, they cannot be held liable because the organization has outsourced its name generation to our facility. Furthermore, the testing is entirely random, so this event is very unlikely.
What random name generation services does ARCpoint offer?
A. ARCpoint offers fully random name generation services and can even manage your drug testing program.
Consortium Services
What is a consortium?
A. A consortium is used for small groups without enough participants to warrant their own random drug testing program. For example, a trucking company with only two or three drivers would have a hard time implementing a successful random drug testing program. Instead, they can join a consortium, where the names of their drivers are pooled with those of other drivers from other companies. Then, the random name generation program selects a driver from that pool. This more completely randomizes their drug testing program.
What are the advantages of an ARCpoint consortium?
A. Many other consortium services will merely inform an organization when one of their participants needs to be tested. ARCpoint will not only inform an organization of who needs to be tested, but will also schedule the testing and perform the test.
How many participants need to be in a consortium?
A. There needs to be at least six participants in a consortium.
How are the names randomly selected?
A. ARCpoint uses advanced computer software to manage all clients and employees. This program can randomly generate names on a monthly or quarterly basis, depending on need.
Breath Alcohol Testing
What are the methods for alcohol testing?
A. Alcohol testing can be done with through a breath test, a urine test, or a hair test.
Can a DOT-regulated commercial motor vehicle driver use a prescription and still perform safety-sensitive duties?
A. Yes, under certain circumstances and as long as the prescription in question is not methadone. Regulations state that, 'A person is physically qualified to drive a CMV if that person does not use a controlled substance. A driver may use such a substance or drug, if the substance or drug is prescribed by a licensed medical practitioner who is familiar with the driver's medical history and assigned duties; and has advised the driver that the prescribed substance or drug will not adversely affect the driver's ability to safely operate a CMV. This exception does not apply to methadone.'
Who falls under DOT regulation?
A. There are more than 12.1 million employees that fall under DOT regulation. These include individuals in the aviation, railroad, trucking, and mass/public transit industries.
Drug Testing
What does ARCpoint do to prevent external dilution?
A. ARCpoint adheres to DOT standards that require that no water be accessible in the collection area (there are no faucets or sinks) and that the toilet water be tinted blue. Flushing the toilet is not allowed.
What can I take into the specimen collection room with me?
A. Test takers are required to empty all pockets, remove all outer garments, and leave briefcases, purses, and other bags behind. Following thorough inspection of its contents, employees can take their wallets with them into the collection area, as long as there is nothing present that could be used to adulterate or tamper with the specimen. They are also required to wash their hands thoroughly before entering the collection room.
What if I forget my ID on the day I'm supposed to take my test?
A. Every employee being tested at an ARCpoint facility is required to show proper picture identification before they can take a test. No ID, no test.
I think I forgot something in the collection room. Can I retrieve it?
A. No. DOT testing regulations state that there can be no unauthorized access to the collection areas. Collectors inspect the collection site prior to and immediately following the collection. It is unlikely you will forget anything anyway, as you are not allowed to take anything in with you.
How will I wash my hands after urinating if there is no water available in the room?
A. There are specific hand-washing areas outside of the collection room.
Why does the collector stand outside the bathroom door during collection?
A. Once the collection process has begun, the collector is mandated to oversee the entire collection process. Immediately after receiving the sample, the collector must test for temperature, color and potential signs of adulteration.
Is there a time limit on how long I can be in the collection area?
A. The DOT prefers that the collection process take only two minutes or less.
Who is required to take a DOT-regulated drug test?
A. The DOT oversees testing for transportation employees and service agents, including self-employed individuals, contractors and volunteers.
What constitutes a refusal to take a DOT drug test?
A. An employee is considered to have refused a drug test if any of the following apply:
  • Failure to appear for any test within a reasonable amount of time after having been directed to do so by the employer
  • Failure to remain at the testing site until the testing process is complete
  • Failure to provide a urine specimen
  • Failure to permit the observation or monitoring (if necessary) of the collection process
  • Failure to provide a sufficient amount of urine without a valid medical explanation of the failure
  • Failure to take an additional drug test requested by the employer or collector
  • Failure to undergo a medical examination or evaluation as part of the verification process
  • Failure to cooperate with any part of the testing process, including a refusal to empty pockets or wash hands
  • Confessing to adulterating or substituting the specimen
What happens if I cannot provide a sufficient amount of urine?
A. Except in the event that the specimen was outside of a normal temperature range or showed other evidence of adulteration or tampering, the collector will discard the specimen and direct the individual to drink up to 40 ounces of fluid throughout the next three hours or so, until the individual has provided enough urine. Refusing to drink is not a refusal to test. It is, however, a refusal to test if the individual refuses to attempt to provide a new specimen or leaves the site before collection is complete.
What are the cutoff levels for drugs, and why do they exist?
A. Federally established cut-off levels reduce the changes of a false positive due to secondhand inhalation or ingestion of a drug-related substance (such as poppy seeds). If an individual tests positive on an initial drug screening, a confirmation test is often ordered that has much lower cut-off thresholds.
  • THC (Marijuana) = 50 ng/ml
  • Phencyclidine (PCP) = 25 ng/ml
  • Amphetamines = 500 ng/ml
  • Cocaine = 150 ng/ml

Regulations state that, 'A person is physically qualified to drive a CMV if that person does not use a controlled substance. A driver may use such a substance or drug, if the substance or drug is prescribed by a licensed medical practitioner who is familiar with the driver's medical history and assigned duties; and has advised the driver that the prescribed substance or drug will not adversely affect the driver's ability to safely operate a CMV. This exception does not apply to methadone.'
What happens to a DOT-regulated employee that tests positive or refuses to test?
A. While the actual employer makes the final call on termination or suspension, the employee will not be able to perform any safety-sensitive duties until that employee has seen a Substance Abuse Professional and successfully completed the return-to-duty process (which includes a Federal drug and/or alcohol test).

Dna Testing

Paternity Tests
What is 'Paternity' and how is it established?
A. 'Paternity' simply means 'fatherhood.' To establish paternity is to determine the child's legal, biological father.
Why is it important to establish paternity for a child?
A. The law states that both parents have the right to a parent-child relationship. However, even if the father does not want a relationship with the child, paternity is important for the following reasons:
  • Financial: Even with an unplanned pregnancy, the law requires both parents to support their child. Most children are placed with their mother, and establishing legal paternity designates who is responsible for paying child support for the child.
  • Medical: Many serious health conditions are inherited, genetic disorders. Establishing biological paternity allows the child to have a more accurate medical history and can improve their overall health and health care.
  • Inheritance Rights: Children naturally have the rights to benefits from both parents, including social security, insurance, veterans and other benefits. They also have inheritance rights.
  • Welfare: Many state and federal social services programs require paternity to be established and declared before a child can be eligible for aid.
  • Identity: Being able to identify both biological parents helps a child know their identity and can avoid identity and behavioral problems in the future.
How can I establish paternity if I am the legally presumed father?
A. Most states have laws establishing the mother's husband as the legally presumed father of the child, if they were married at the time of birth or if the mother has been divorced or widowed for less than 10 months at the time of birth. To refute this, the legally presumed father must request a DNA paternity test to establish legal paternity.
What can I do if the legally presumed father will not allow a voluntary acknowledgement of paternity?
A. Generally, voluntary acknowledgements of paternity are not allowed unless the legally presumed father consents to it or a Court determines that the legally presumed father is not, in fact, the biological father of the child. The best way to reconcile this situation is to request a DNA test be conducted on the child, mother, and the potential father.
What rights does a father have to his child?
A. Depending on the situation, the mother and father (or the Court) can establish visitation, custody, and other paternal allowances. The law in most states establishes that a father has the right to develop a relationship with his children.
Does a court have the authority to force me to take a paternity test?
A. Yes. The court can and often will require a potential father to take a paternity test, especially when attempting to establish child support. If you refuse this test, you will likely be charged with contempt of court.
How long does it take to conduct a DNA paternity test?
A. It only takes about 5 minutes to collect the actual DNA specimen samples. However, due to paperwork, it is best to schedule additional time.
Does ARCpoint do prenatal paternity testing?
A. No. ARCpoint does Buccal swab after birth. Prenatal paternity procedures, such as amniocentesis, are very rare and dangerous for both the mother and child. You would need to be contact your doctor to find out if you should pursue this course of action.
Does the child have to be a certain age for a Buccal swab test?
A. No. In fact, the procedure can be done immediately after birth, if necessary.
Who needs to be present for paternity testing?
A. The mother, child, and alleged father(s) will need to be present. However, everyone does not need to present at the same time. We can arrange different collection times for everyone.
Is it possible to alter your DNA?
A. No. Age, eating, medication, and other factors have no bearing on DNA.
Maternity Tests
What circumstances would require a maternity test?
A. Maternity test results may be used to:
  • Confirm that an adopted child has been reunited with his/her birth mother
  • Confirm an embryo was implanted into the right mother through in-vitro fertilization
  • Prove maternity in a hospital mix-up
  • Prove maternity in an immigration case
Who needs to be present for maternity testing?
A. The child, the father, and the alleged mother need to be present for the most accurate results.
What method is used for maternity testing?
A. Maternity testing is conducted through Buccal swab specimens, exactly like paternity testing.
Infidelity Tests
How does infidelity testing work?
A. Infidelity testing tests an article of clothing for semen samples. If a sample is found, it can be tested for DNA evidence and compared to a third sample.
I think my wife is cheating. Will the results be accurate if the other man had a vasectomy?
A. No. If the male partner had a vasectomy, there will be no DNA to test (DNA is in sperm cells, not seminal fluid). The test will not be able to be performed.
Method
What can I do if the legally presumed father will not allow a voluntary acknowledgement of paternity?
A. Generally, voluntary acknowledgements of paternity are not allowed unless the legally presumed father consents to it or a Court determines that the legally presumed father is not, in fact, the biological father of the child. The best way to reconcile this situation is to request a DNA test be conducted on the child, mother, and the potential father.
How long does it take to collect a specimen for a DNA paternity test?
A. It only takes about 5 minutes to collect the actual DNA specimen samples. However, due to paperwork, it is best to schedule additional time.
Does ARCpoint do prenatal paternity testing?
A. No. ARCpoint does Buccal swab after birth. The method of collection is so safe and simple that we can even come to the hospital after delivery to collect a DNA sample from your baby.
Does the child have to be a certain age for a Buccal swab test?
A. No. In fact, the procedure can be done immediately after birth, if necessary.
Court Admissible Results
What legal impacts can a paternity test have on my custody case?

A. Yes. ARCpoint can provide expert, in-court witness and testimonial services when required.

Drug Free Policy Creation
What is a Drug-Free Workplace program?
A. A Drug-Free Workplace program generally includes five components aimed at deterring drug use in the workplace. These five parts are:
  • A Drug-Free policy
  • Supervisor training
  • Employee education
  • Employee assistance
  • Drug testing
Won't implementing a Drug-Free Workplace program make my employees feel like suspected criminals?
A. An organization can decide individually how to handle its Drug-Free Workplace program. Many companies focus on the detection, apprehension, and termination of employees caught abusing drugs or alcohol. On the other hand, other organizations emphasize obtaining treatment and assistance, and provide return-to-work programs for abusing employees. It is the determination of each organization how to handle their policy and program.
What are the biggest mistakes that can be made in a Drug-Free Workplace Program?
A. There are many incorrect practices that can reduce the effectiveness of a drug-free workplace program. These include focusing only on illicit drug use and ignoring alcohol abuse, an excessive dependence on drug testing, restricting benefits or access to treatment for employees, and terminating employees instead of providing rehabilitation services.
What are the benefits of a Drug-Free Workplace program to an employer?
A. An employer can benefit from a Drug-Free Workplace program in many ways. The most obvious is a discount in Workers' Compensation premiums offered in many states. Furthermore, by discouraging employees from abusing alcohol and drugs and screening job candidates for such abuse, an employer creates a safer work environment and will reduce workplace accidents and the reduced productivity generated by abusing employees.
