There is a new method of alcohol testing that does not even require individual consent. Passive alcohol testing devices can:

• Evaluate breath alcohol content from more than a foot away from the individual's mouth.
• Detect the presence of open containers in the vehicle.

In California, law enforcement are attaching these "electronic alcohol nose" sensors on flashlights and other small, unobtrusive devices.
