Due to the absence of chain of custody protection, the results of most infidelity tests are not court admissible because the specimen is often collected privately in a home. Chain of custody laws require that the specimen only pass through certain hands. To establish proper chain of custody, the specimen must be collected under the supervision of a neutral third party at a lab or hospital.

How does infidelity testing work?

A. Infidelity testing tests an article of clothing for semen samples. If a sample is found, it can be tested for DNA evidence and compared to a third sample.

I think my wife is cheating. Will the results be accurate if the other man had a vasectomy?

A. No. If the male partner had a vasectomy, there will be no DNA to test (DNA is in sperm cells, not seminal fluid). The test will not be able to be performed.
